Not Above the Law: AOC Sued for Blocking Twitter Users from Official Account

  • In a case similar to President Trump’s, Democratic Rep. Alexandria Ocasio-Cortez is being sued for blocking Twitter users from accessing her account.
  • YouTube personality Joseph Saladino and former New York lawmaker Dov Hikind have filed suits against AOC for blocking them on Twitter.
  • Citing the recent Trump case where a court ruled that Trump violated users’ First Amendment rights by blocking them from his official account, Saladino and Hikind said “the law should apply to all politicians.”
  • Saladino tweeted: “Trump is not allowed to block people, will the standards apply equally?”
  • In his suit, Hikind said that AOC “prevented him from viewing her account because of opinions he expressed about her in replies on the social media site.”
  • The suit reads in part: “Because of Plaintiff’s criticisms of AOC, Mr. Hikind has been prevented or impeded from viewing AOC’s tweets, from replying to the tweets, from viewing discussions associated with the tweets, and from participating in those discussions.”
  • Hikind has described himself as “a staunch supporter of Jewish values” and said he “was blocked purely because of his speech in support of Jewish values and Israel.”
  • Hikind has also claimed that other journalists have been blocked, preventing them from interacting with AOC.
  • In the court’s ruling on Trump’s case, it read: “The First Amendment does not permit a public official who utilizes a social media account for all manner of official purposes to exclude persons from an otherwise‐open online dialogue because they expressed views with which the official disagrees.”
  • AOC has more than 4.6 million followers on her Twitter account and is known for her “clapbacks,” where she wittily replies back to her opponents.
